By enrolling in courses offered by Indaba Group, LLC (operated by Julie Murphy), you agree to these Terms and our Privacy Policy. Please read carefully before enrolling.

1. Enrollment & Access

Agreement: Course enrollment requires acceptance of these Terms & Conditions and our Privacy Policy. You must be 18+ to enroll.


Platforms:
Courses are delivered through a hosting platform such as GoHighLevel (GHL). Live sessions use a communication platform such as Zoom or Google Meet.

Account: You are responsible for keeping login credentials secure. One enrollment = one user. Do not share access.

Access Duration: Course material access periods vary by program and will be clearly communicated upon enrollment. All deadlines and expiring timelines, including those for recording sessions, materials, and certification submissions, are specific to each program and binding once enrollment is confirmed. Indaba Group, LLC reserves the right to update, modify, or retire course programs with 90 days advance notice.

Technical Requirements: In order to participate in the course, you need internet, a compatible device, and email. For live sessions, you need Zoom capability.

2. Live Sessions & Recording Consent

By enrolling in courses with live sessions, you consent to:

● Being recorded on video and audio during live sessions

● Your name and image appearing in recordings

● Recordings being shared with enrolled students only

● Recordings used solely for educational purposes

Your Options: You may turn off your camera or use a first name only. If you do not consent to recording, unfortunately you will not be able to participate in the live sessions, which are fundamental to the official certification.

You May Not: Record sessions yourself, share recordings, or use them commercially.

3. Payment & Refunds

Payment: Full payment due at enrollment. Payment plans may be available for some courses, as detailed in the course information.

Refund Policy:

All payments are in USD and are non-refundable. If there is a course-specific refund policy, details of such will be provided in the course information. Requests are assessed on a case-by-case basis at the discretion of Indaba Group, LLC.

4. Intellectual Property

You May: Access content during enrollment, download designated materials for personal use, practice techniques personally or professionally.

You May NOT: Share, copy, reproduce, sell, or distribute course materials. Record or screenshot content. Teach our copyrighted content without certification and permission.

Ownership: All course content is owned by Indaba Group, LLC and protected by copyright law. We reserve the right to update, edit, or remove course content at our discretion to ensure quality and accuracy. While we strive to maintain content availability, we cannot guarantee that any particular course or content will remain available indefinitely.

5. Liability Waiver & Assumption of Risk

IMPORTANT - READ CAREFULLY:

You Acknowledge:

● Meditation and deep relaxation practices may bring up intense feelings, memories, or psychological experiences

● These practices are not a substitute for mental health treatment

● You voluntarily assume all risks of participation

● You are responsible for practicing within your own limits and comfort level

● You will consult your healthcare provider before starting  a meditation and/or deep relaxation practice, especially if you have mental health conditions, trauma history, dissociative disorders, or psychological concerns

You Release & Hold Harmless:

Indaba Group, LLC, and Julie Murphy, from ANY liability, claims, or damages arising from your participation, including injury, illness, or death.

You Agree:

● This course is NOT medical advice or treatment

● You have medical clearance to participate OR have consulted your doctor if required 

● You will modify or stop if anything causes pain or distress 

● You understand this course does not guarantee results or outcomes

Maximum Liability: Our total liability is limited to the amount you paid for the course.

6. User Conduct

Do: Use courses respectfully and lawfully. Treat instructors and students with respect.

Do not: Violate laws, infringe copyrights, harass others, hack systems, share false information, or use courses for unauthorized commercial purposes.

Consequences: Violations may result in immediate termination without refund.

7. Termination

You: May stop using services anytime.

Us: May terminate your access for violations of Terms & Conditions, prohibited activities, or if we discontinue services.

Effect: Upon termination, access ends immediately. Outstanding payments remain due. No refunds unless otherwise stipulated in a course description.

8. Privacy & Data

Your privacy matters. The Privacy Policy below explains how we collect, use, and protect your personal information, including GDPR and CCPA compliance. By enrolling, you agree to our Privacy Policy.

9. Disclaimers & Limitations

"As Is" Basis: Courses provided as-is. We do not guarantee uninterrupted access, specific outcomes, or compatibility with all devices.

We Are Not Liable For:

● Technical issues, platform downtime, or third-party service failures

● Internet connectivity or device problems

● Indirect, consequential, or punitive damages

● Personal injury or illness from participation

● Decisions you make based on course content and/or course participation 

Limitation: Our maximum liability is the amount you paid for the course.

10. Changes to Terms

We may update these Terms occasionally. Significant changes will be emailed to you. Minor updates will be posted on our website. Continued use after changes means acceptance.

11. Dispute Resolution

Governing Law: Florida law applies.

Jurisdiction: Disputes resolved in Palm Beach, Florida, USA courts.

EU/UK Residents: You may also have rights under EU consumer protection laws and may bring proceedings in your country of residence.

12. General Terms

Entire Agreement: These Terms & Conditions and Privacy Policy constitute the complete agreement.

Severability: If any provision is unenforceable, others remain valid.

No Assignment: You cannot transfer your rights. We may assign ours.

Survival: Intellectual property, liability, and dispute sections survive termination.
